This article examines the implications of the Privacy and Electronic Communications (EC Directive) Regulations 2003, which came into force on 11 December 2003. They apply to the sending of direct marketing messages by electronic means - for example, telephone, fax, email, text message and electronic picture message or automated calling systems, i.e. unwanted junk mail sent by the above modes of communication.
It also looks at when consent is needed and the consequences of the Regulations depending on the mode of communications and the type of recipient.
